How to setup a LGPD compliant CMP?

In this article, we will take a look at how the Usercentrics CMP can be built into your website in order to be compliant with the Brazilian Data Protection Law (LGPD).

In this article, we will take a look at how the Usercentrics CMP can be built into your website in order to be compliant with the Brazilian Data Protection Law (LGPD).

The LGPD and the European Data Protection Law GDPR have several similarities but also some differences. In order to be privacy compliant, we have to take those into account.

  1. Please navigate to the tab “Configuration”: Under the “Setup” tab, you can find the editable and visible languages. Since LGPD is a Brazilian Legislation, make sure you add the Brazilian Portuguese language to your CMP as editable and visible language.

2. Continue to the tab “Legal Specifications” and “Regional Settings”.  Specify below for which users your settings should be displayed. Select “Display CMP to all users”.

3. Remain in the same tab and scroll down to the legal frameworks. Make sure that the default status, which is the GDPR version, is enabled.

Do not check CCPA or TCF.

4. In order to be fully LGPD compliant, please have a look at the Data Processing Services. Navigate to “Service Settings” and click on “Data Processing Services”.

5. Add any Data Processing Service that you use. For this example, we will select “Google Analytics”.

6. Open the service to adjust the legal basis.

7. Scroll to “Legal Basis” and “Use custom legal basis”.

8. Once you have opened the custom legal basis, enter “LGPD” in the search bar. Here you will find the different legal bases defined by the LGPD. Finally, select the legal basis that fits your needs for each of your Data Processing Services.

9. Finally, please check that all the information in our predefined templates is consistent with your data processing services and use our "Custom Templates" if necessary. Here you can enter all the information adapted to your needs.

Congratulations! With this setup, you are good to go for your operations in Brazil.
